Africell is introducing the Pay Af Af Service where eligible Africell customers can purchase a new Samsung A02 smartphone via manageable monthly installments of up to nine months, receiving 3GBs of free data on payment of each monthly installment.

To be eligible for this service, you must be over 18 years of age, you must have been an Africell customer for 3 months or longer and you must meet certain other criteria
If you are eligible for this service, you will select an instalment plan, make your first instalment payment upfront via Afrimoney and collect your Samsung A02 smartphone from the closest selected Africell store. Alternatively, you can visit a selected Africell store to follow this process in-store
You will be able to select from the following instalment plans:
• 6 monthly instalments of NLe 330, with your first instalment upfront
• 9 monthly instalments of NLe 230, with your first instalment upfront
You will receive 3GB of free data on each monthly instalment, valid for 30 days
Terms & Conditions for the Africell “Pay Af Af” Service

The below terms and conditions apply to the Africell Pay Af Af Service (“the Service”). This agreement between the subscriber/customer and AfriCredit SL Limited shall come into force from the date of commencement of the service when the device is activated after successful registration and payment of the first instalment by the Customer.

The Customer hereby agrees to the following terms and conditions:

Definitions & Interpretation

In this Agreement the following words and expression shall have the following meaning: “Agreement” or “Terms and Conditions” means these terms and conditions.

“Customer” means a person who purchases a device using Pay Af Af service.

“Device” means the handset to be purchased by the Customer by way of monthly instalments as listed by Africell.

“Data” means the data volume in terms of the internet limit that the Customer can utilize.

“Payment” means the monthly instalments (inclusive of GST) payable by the Customer to Africell for the Devices at Africell POS.

“Service” enables Africell subscribers to purchase devices through a six (6) or nine (9) month instalment plan.

Eligibility

The Pay Af Af Service is only open to subscribers:
i. Who have been using Africell services for 3 months or more
ii. Who are 18 years of age and over
iii. With National ID, NCRA Pin, Passport, Driving License or Voter ID

Release of Devices & Warranty Terms

(a) The device will be locked to the Africell network for a period of three years from the date the device becomes active, during which it will remain under the control of Africell, and after which the device will be freed from this restriction.
(b) The device will be released to the customer upon payment for the Device in full.
(c) All risks associated with the Device will pass to the Customer upon collection of the Device from Africell. For the avoidance of doubt, Africell will not be responsible for any loss of or damage to the Device upon collection of the device(s). The title to the Device will pass to the Customer upon payment for the Device in full.
(d) The Device is sold subject to the manufacturer’s limited warranty. The device comes with a Samsung warranty, available at a Samsung authorized service center.
• In case there is a factory issue (to be determined by Africell), the device will be repaired without any cost (FREE)
• Damage to the device as a result of negligence on the part of the customer and outside of the manufacturer’s warranty conditions, the customer will be fully responsible for the totality of the repairs.
(e) The Customer agrees that once the device has been collected there will be no replacement or repair unless the same is under the manufacturer’s limited warranty.
(f) Value of the Device is as at the date of the Customer’s application. No adjustment shall be made for related promotions or price cuts offered by Africell.
(g) All collected Devices shall be governed by the terms of this Agreement.

Free Data

(a) The customer shall be provided with 3GB of free data on payment of each instalment on the date specified, same is valid for 30 days from the time of activation after which the free data will expire.

Payment for the Devices

(a) The payment period of any device is 6 to 9 months and payment is via Afrimoney platform.
(b) It is agreed that the customer shall continue making payments even in the event of loss or theft of the Device or where the Device is faulty outside the period of the manufacturer’s warranty.
(c) Repayment will be due in monthly intervals commencing on the date of the first payment and the customer must pay using Afrimoney via the USSD *4333#.
(d) In the event the customer fails, refuses and or neglects to pay the amounts due within seven days from the due date Africell will lock the device until the due payment is made.

Privacy

This Agreement is governed by any data or privacy law or regulation in force at the time of signing this Agreement or coming into force after the signing or during the term of this Agreement.

Term & Termination of the Agreement

This Agreement shall come into force on the date of signing and release (successful activation of the device which includes full registration, payment of first installment and any other activation term stipulated by Africell).

Governing law

This agreement and any dispute or claim arising out of or in connection with it (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of Sierra Leone.

Jurisdiction

Each Party irrevocably agrees that the High Court of Sierra Leone shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement or its subject matter (including non-contractual disputes or claims).

General

(a) If any of the words or provisions of this Agreement shall be construed to be illegal, void or invalid, that shall not affect the legality and validity of the other words or provisions. If any restriction is held not to be valid but would be valid if part of the wording were deleted or its extent reduced or modified then such restriction shall apply with such deletion, reduction or modification as may be necessary to make it enforceable
(b) None of the provisions of this Agreement is intended for the benefit of or shall be enforceable by any third parties.

Application of the Terms and Conditions for Africell’s Services

Any published Customer terms and conditions and for Africell’s services will apply to this Agreement to the extent that such terms and conditions have not been varied by this Agreement.

Extension of Terms

Africell reserves the right to amend or vary these terms and conditions or to withdraw the Service at any time if the customer is in default of the terms and provisions of this Agreement. In any of these events, notice will be given via media advertisements, SMS and other electronic means of communications (including at Africell’s discretion on the Africell website www.africell.sl) and will be effective immediately or as at the date referred in such notifications.

What is the Pay Af Af Service?

Pay Af Af makes it possible for Africell customers who meet certain criteria to purchase a Samsung A2 smartphone via monthly installments (6 or 9 months).

Who is eligible for Pay Af Af?

Africell customers who are over 18 years of age, have been an Africell customer for 3 months or longer and meet certain other criteria are eligible for this service.

Can an eligible Africell customer purchase a phone on instalment plan for someone else?

Eligible Africell customers can purchase a phone on instalment plan for themselves or for another person but the eligible Africell customer will be responsible for paying the monthly instalments.

What payment options are available to purchase a phone?

A customer can purchase the phone via 6 monthly instalments of NLe 330 or 9 monthly instalments of NLe 230. The first payment is made up front, on registration, with 5 or 8 payments to follow dependent whether a 6 or 9 month plan was chosen by the customer. Once a customer has made all payments, the phone will be released and ownership will be transferred to the customer.

How can a customer purchase a phone on instalment plan?

Dial *4333# to check eligibility. If a customer is eligible, he will be able to select their plan (6 or 9 months) and make their first installment via Afrimoney only. If a customer is not already registered on Afrimoney, they must register and have the first installment amount in their Afrimoney account in order to pay the first instalment. Once the first instalment is paid, a customer will be directed to an Africell store to collect their phone.

How do you register for Afrimoney?

Dial *161# from an Africell number and follow the instructions. The customer will need to be registered with Afrimoney and have the due amount in the Afrimoney wallet in order to make payment.

Where can a customer collect their phone?

Devices will be available in selected Africell shops nationwide. Once the customer has paid the first instalment (by dialing *4333# USSD and following the steps), they can collect the phone from a selected Africell store which will be indicated on the screen once the payment has been made. Alternatively, they can go to the following selected stores:
Bathurst St., Bottom Mango, HQ, Juba, Odeon, Shell, St. John, Waterloo, Wilkinson Road (Freetown)
Kabala, Kono, Lungi Airport, Magburaka, Makeni (North)
And Bo (South)

How can a customer make pay their monthly instalment?

Dial *4333#, press 3 to Make a Payment, and follow the instructions. The customer will need to be registered with Afrimoney and have the due amount in the Afrimoney wallet in order to make payment.

Can a customer pay more than their scheduled monthly installment amount?

Yes, a customer can pay more than the monthly installment amount and once the total plan amount has been paid the phone will be released, but the phone will be locked for Africell SIM for 3 years from the purchasing date.

How can a customer view their remaining balance?

Dial *4333# and press 2 for Account Summary.

What happens once the plan is fully paid / last installment is paid?

A customer will no longer have a device financing plan with Africell. If the customer has paid the total plan amount before the instalment period is complete (6 or 9 months), the customer will continue to receive 3GB each month (valid for 30 days) until the end of the plan they originally selected on purchase of the device (6 or 9 months).

What happens to a customer’s monthly payments if their device is lost, stolen or damaged?

If the phone is lost, stolen or damaged, the customer is still responsible for paying their monthly instalments until the full plan amount is paid. If the phone has been lost or stolen a customer must phone customer service on 111 from an Africell number (at no cost) or 232 77 111 111 from a non-Africell number to report it to Africell, so that the phone can be locked.

When a customer’s phone has been locked, what can they do to unlock it?

If a customer fails to make a due payment and their phone has been locked, the customer must dial *4333# from another Africell number (at no cost), follow the instructions to make payment, and their phone will be unlocked automatically. If the phone has been locked due to it being lost, stolen or damaged the customer must contact customer service on 111 from an Africell number (at no cost) or 232 77 111 111 from a non-Africell number to unlock the phone after the customer’s personal information has been verified. Alternatively, they can visit an Africell store for further assistance.

Is there a warranty for the device?

Yes, the device comes with a Samsung warranty, available at the Samsung authorized service center (address 27 Siaka Steven Street, Freetown, Sierra Leone):

• Any factory issue, the device will be repaired without any cost (FREE)
• For damaged devices, the customer will be liabile to pay the full cost of repairing the device

Will customers receive Africell bonuses as part of this service?

Africell will provide customers with 3GB of free data immediately effective on payment of each instalment and valid for 30 days from date of activation.

How long is this service available for?
